Required documentation
A foreign or international association or foundation and other non-profit organisations (hereinafter: foreign non-governmental organisation) may establish an office, a representative office or another organisational form (hereinafter: office or representative office) in Bosnia and Herzegovina.
The application for the registration of an office or representation of a foreign non-governmental organisation is submitted to the Ministry on Form 4.
The application with attachments is completed on a computer, in Latin script or Cyrillic script, in one of the official languages of Bosnia and Herzegovina, within the relevant section.
The request and its attachments must be submitted in a single copy.
The application must be submitted in the original, and any attachments must be submitted in the original or as a certified copy, no older than three months.
The application for registration in the register is signed by the authorised representative of the office or representation of the foreign non-governmental organisation, or by the person authorised to carry out the registration.
Along with the application for the registration of an office or representation of a foreign non-governmental organisation in the register with the Ministry of Justice of Bosnia and Herzegovina, the following must be attached:
a) a registration certificate or an extract from the register of a foreign non-governmental organisation in its country of origin, or another written document where registration of a non-governmental organisation is not required by the law of the country of origin;
b) if the evidence from paragraph 1(a) of this article does not contain information on the statutory aims and activities of the foreign non-governmental organisation, it shall also attach the statute or any other internal act of the foreign non-governmental organisation, on the basis of which the Ministry determines the objectives and activities of the foreign non-governmental organisation, for the reason that the office or representation may carry out in Bosnia and Herzegovina only those registered objectives and activities, or part thereof;
c) a decision by the competent body of the foreign non-governmental organisation on the opening of an office or a representative office in Bosnia and Herzegovina, which specifies: the objectives and activities, the seat and address, the name and surname of the person authorised to represent it, and a description of the seal and emblem of the office or representation in Bosnia and Herzegovina;
d) a certified copy of the identity card of the person authorised to represent the office or representation of the foreign non-governmental organisation, and if that person is a foreign national, a certified copy of their passport and residence permit in Bosnia and Herzegovina;
e) a certified signature of the person authorised to represent the office or representation of the foreign non-governmental organisation by the competent authority;
f) proof of payment of the administrative fee.
The annexes listed in paragraph 1(a), b) and c) of this Article must be certified by the competent authority with an apostille stamp in the country of origin and translated into one of the official languages in use in Bosnia and Herzegovina by an authorised court interpreter, and certified by the competent authority of Bosnia and Herzegovina, unless otherwise provided for by a special regulation.
