Amendments and supplements to the registration

A registered association or foundation is obliged to submit an application to the Ministry for the registration of any change to the facts entered in the register of associations or foundations, when a change has occurred to a fact entered in the register, on Form 2, within 30 days of the date the changes occurred, such as: amendments and additions to the statutes/adoption of a new statute of the association or foundation (the name and abbreviated name of the association or foundation, the address of its registered office, the emblem of the association or foundation, the purposes and activities for which the association or foundation was established, etc.), the appointment and dismissal of the management bodies of the association or foundation, or the persons authorised to represent the association or foundation.

Along with the application for registration of changes in the register, the registrant shall attach:

a) a decision to amend or supplement the statutes, or a decision to adopt a new set of statutes, when the association or foundation adopts a new set of statutes, in two copies;

b) the decision of the competent body of the association or foundation regarding the change referred to in paragraph 1 of this article;

c) in the event of a change of the person authorised to represent the association or foundation, a certified copy of their identity card or passport and a residence permit in Bosnia and Herzegovina if the authorised representative is a foreign national, and a notarised signature of the person authorised to represent the association or foundation from the competent authority;

d) statements from the members of the foundation's board of directors accepting their membership of the board, certified by the competent authority;

e) a minutes or an extract from the minutes of the meeting of the association's general assembly or the foundation's board of directors, and

f) proof of payment of the administrative fee. 

The application to register changes in the register is signed by the person authorised to represent the association or foundation, and is certified with the association's or foundation's seal.

The application for the registration of changes is completed electronically, in Latin or Cyrillic script, in one of the three official languages in use in Bosnia and Herzegovina, in the appropriate fields. The application and its attachments must be submitted in the original or as a certified copy no older than three months, in a single copy, except for the statute, which must be submitted in two copies.

 

Registered office or representative office of a foreign non-governmental organisation are required to submit an application to the Ministry for the registration of any change in the register when a fact entered in the register on Form 5 has changed, such as: the name and abbreviated name of the foreign non-governmental organisation in its country of domicile, or of its office or representation in Bosnia and Herzegovina; the addresses of the registered office of the office or representation of the foreign non-governmental organisation; the seal or sign of the office or representation of the foreign non-governmental organisation; objectives and activities of the office or representation; persons authorised to represent the office or representation of the foreign non-governmental organisation in Bosnia and Herzegovina, within 30 days of the change occurring.

Along with the application for registration of changes to the register of offices or representations of a foreign non-governmental organisation, the following must be attached:

a) a registration certificate or an extract from the register of a foreign non-governmental organisation in its country of origin, or another written document, where registration of the non-governmental organisation is not required by the law of the country of origin;

b) a decision by the competent body of the foreign non-governmental organisation regarding the change that has occurred;

c) a certified signature of the authorised representative of the office or representation of the foreign non-governmental organisation in Bosnia and Herzegovina, together with a certified copy of their identity card/passport and proof of residence permit in Bosnia and Herzegovina if the representative is a foreign national;

d) proof of payment of the administrative fee. 

The documents referred to in paragraph 2(a) and (b) of this Article must be certified by the competent authority with an apostille stamp in the country of origin and translated into one of the official languages used in Bosnia and Herzegovina by an authorised court interpreter, certified by the competent authority of Bosnia and Herzegovina, unless otherwise provided for by a special regulation, and not older than three months.

The application for the registration of changes to the register of an office or representation of a foreign non-governmental organisation is signed by the person authorised to represent the office or representation of the foreign non-governmental organisation in Bosnia and Herzegovina, and is certified with the seal of the office or representation of the foreign non-governmental organisation.
