Foundation registration

The application for registration of an association or foundation is submitted to the Ministry on Form 1, together with a list of the association's or foundation's founders on Form 1.1.

The application is completed electronically, in Latin script or Cyrillic script, in one of the three official languages in use in Bosnia and Herzegovina, in the appropriate fields.

The application is signed by the person authorised in the founding act of the association or foundation to submit the application for registration in the register on behalf of the founder.

The application and its attachments must be submitted in the original or in a certified copy no older than three months, in a single copy, except for the statute, which must be submitted in two copies.

In the application for the registration of an association or foundation, the applicant classifies the association or foundation in accordance with its objectives and activities.

The association or foundation independently determines its objectives and activities in accordance with the Constitution and the Law.

An association or foundation independently classifies itself, according to its own choice, into one or more areas of activity, and the information is entered into the register of associations and foundations.

Along with the application for registration of the foundation in the register (Form 1), containing the information referred to in Article 7(1) of these regulations and the list of the foundation's founders (Form 1.1), the applicant shall attach:

a) the foundation's founding act, in accordance with Article 23 of the Act;

b) certified copies of the identity cards of the founders who are citizens of Bosnia and Herzegovina,

or passport – of the foreign founder, or an extract from the register for a legal person founder or another legal act proving the status of the legal person founder of the foundation;

c) the foundation's statutes in two copies, in accordance with Article 24 of the Act;

d) a personal identity document, or an extract from the register, proving the identity of the founder, where the foundation is established by a unilateral declaration of intent, contract, will, legacy or other appropriate legal act;

e) a certified statement from the applicant, made under full moral, material and criminal liability, declaring that the foundation in formation has not been registered under the same name with another registration authority in Bosnia and Herzegovina;

f) the decision of the founder on the appointment of the decision of the founder on the appointment of the foundation's board of directors, which contains the names, surnames and addresses of the appointed persons, their duties on the board, the duration of their term of office, the date on which the decision comes into force, and the date, number and signature of the foundation's founder;

g) statements from the members of the foundation's board of directors confirming their acceptance of membership, certified by the competent authority;

h) the decision of the foundation's board of directors on the appointment of the person authorised to represent the foundation, which contains the first name, surname and address of the person appointed to represent the foundation, the duration of the term of office, the date on which the decision comes into force, the date, number and signature of the chairman of the foundation's board of directors;

i) a certified signature of the person representing the foundation;

j) a specimen of the foundation's sign, if prescribed by a provision of the articles of association;

k) translation of the foundation's name into the languages in official use in Bosnia and Herzegovina, pursuant to Article 7(5) and (7) of the Act, certified by an authorised court interpreter;

l) translation of the foundation's name into a foreign language, if the foundation, in accordance with its statutes, also has a name in a foreign language, certified by an authorised court interpreter;

m) consent under Article 7(6) of the Act if the name of a foundation includes the name of a natural person;

n) consent of the competent authority of the city, municipality or settlement for the use of the name of the city, municipality or settlement in the foundation's name;

o) the amount of cash or other assets which the founder contributes upon the establishment of the foundation;

p) proof of payment of the administrative fee, and

r) other evidence in accordance with the foundation's statutes.
