Procedure for exercising rights

Communication between the member states of the Convention on the Enforcement of Maintenance Claims Abroad is carried out through central bodies.

Maintenance creditors from Bosnia and Herzegovina address their maintenance claims to the competent entity bodies dealing with social welfare, namely: the Federal Ministry of Labor and Social Policy, the Ministry of Health and Social Protection of the RS and the Judicial Commission of the Brčko District of BiH.

After that, the competent bodies submit the claims, with the necessary documentation, to the Ministry of Justice of BiH.

The obligation of the Ministry of Justice is to determine whether the submitted claims have been made in accordance with the provisions of the Convention, and whether they are complete. If the claims are not made in accordance with the provisions of the Convention, the Ministry of Justice will return them to the competent entity administrative bodies for correction and/or amendment.

The Ministry of Justice will forward duly submitted maintenance claims submitted through the competent entity administrative bodies to the competent central body in the debtor's state, and continuously monitor their implementation.

If the alimony creditor mistakenly submits a request directly to the Ministry of Justice, instead of to the competent body, the Ministry will send such a request to the competent entity body, and that body is obliged to act on it as if the request was addressed to it.

The Ministry, through the competent entity body, will inform the alimony creditor about all information related to a specific alimony request.
