Prepared Draft on Amendments to the Law of Bosnia and Herzegovina on Execution of Criminal Sanctions, Detention and Other Measures

26.09.2008.- Ministry of Justice of BiH has prepared a working version of amendments to the Law on Execution of Criminal Sanctions, Detention and Other Measures, in accordance to European Prison Rules, i.e. to the changes in European penal policy, practice of punishment and prison management. The proposed amendments, among all, provide strict conditions for giving privileges during serving criminal sanctions and provide for the method of “assessment of risk” of prisoners.
Very clear criteria for assessment and estimation of the risk of escape at the time of using the privileges are proposed, but also criteria by which the management of the institutes is lead at the time of determining the measures of supervision of the persons who are not under obligatory supervision.
Provisions on time spent serving the sentence are also changed, and the conditions for obtaining the privileges out of the institution. Thus, the persons sentenced for the most serious criminal offence can achieve privileges only after serving three fifths of the sentence.
The proposed amendments in Bosnia and Herzegovina for the first time provide for establishment of the Independent Committee for monitoring of human rights, control of treatment of prisoners and control of conditions in prison institutions.
The work on the Independent Committee will also enable to provide, in faster and more efficient way, necessary financial means for sanation, adaptation, reconstruction and building of new objects. In the cases of possible riots, rebellions or strike in prisons, the supervision of the Independent Committee will contribute to more objective information to the public and to the competent authorities on such events, which will disable ungrounded pressures of the prison population in requesting the rights opposite to prison provisions or indirect political intervention into the work of the prison system.
