Established Amendments to the Criminal Code of BiH

05.11.2009. - Council of Ministers of BiH has established the Proposal of the Law on Amendments to the Criminal Code of BiH. With the adoption of these amendments, Bosnia and Herzegovina will meet the four conditions for liberalization of the visa regime and align legislation in this area with the solutions in EU countries.  

Out of the amendments proposed by the MPs, after they refused to accept previous Proposal of the Law by the Council of Ministers of BiH, four amendments were incorporated into the Proposal of the Law on Amendments to the Criminal Code of BiH, six amendments were partially accepted and 14 amendments were not accepted. According to the proposed amendments, the Court of BiH, inter alia, will be able to confiscate an assets of the persons suspected or accused of organized crime or other serious criminal offences, if it establishes that there is a probable cause to believe that the assets derive from a criminal offence. Beside introducing new principle of proving the origin of an assets, the provisions on the punishment and denial of the holocaust and genocide are also clearly defined, as well as the provisions related to insults on national and religious grounds.

Agreed text of the Law was proposed by the Team for monitoring and evaluation of criminal legislation in BiH, consisted of professors from Faculties of Law, representatives of the Court and Prosecutor's Office of BiH, HJPC, President of the Appellate Division of Brcko District, Entity Chief Prosecutors, Presidents of entity criminal divisions and representatives of Bar Associations of RS and FBiH. 

Ministry of Justice of BiH will submit the Proposal of the Law on Amendments to the Criminal Code of BiH to the Parliamentary Assembly of BiH for consideration in a basic procedure.
