Memorandum on Protection against Unlawful Processing of Personal Data

October 30, 2008 - Minister of Justice of Bosnia and Herzegovina, Mr. Bariša Čolak will sign tomorrow (October 31, 2008) in Chisinau – Republic of Moldova, Memorandum on Legal and Judicial Guarantees against Unlawful Processing of Personal Data. Memorandum will be signed by all Ministers of Justice and Home Affairs of member states of the South-East European Cooperation Process (SEECP).
By signing the Memorandum, SEECP member states, are obliged to: in the national legal framework as well as in regional cooperation give effect to the basic principles for data protection that are processed in public and private sectors. All State Parties, among other, will be obliged to establish independent supervising authority which will monitor national data protection system and which will have the power to investigate and intervene in the process of unlawfully processing of personal data.
Common commitment to strenghten the system of personal data protection is the result of estimated threat of spreading cross-border cybercrime, i.e. damage and consequences made to banking systems and to entire economic security of the states by this kind of crime. Memorandum creates the preconditions for establishment and application of provisions and procedures determined by various Conventions in the area of human rights, data protection, organized crime and cybercrime as well as police cooperation in the South-East Europe.
