Amendments to the Law on Civil Service Soon

29.08.2008 - Intersectoral Working Group appointed by the Minister of Justice of Bosnia and Herzegovina has made a Pre-Draft of Amendments to the Law on Civil Service in the Institutions of Bosnia and Herzegovina. The amendments shorten and improve procedures of employment and choice of staff, improve and advance selection of staff, planning of human resources and evaluation of work… The provisions of the Law, for the first time regulate methods, procedure and conditions of direct takeover of civil servants from the Entity administrative bodies and vice versa.

For the first time the methods, procedures and conditions of employment of trainees are regulated, as well as a possibility of employment of a trainee with a status of civil servants after finished internship and passed professional administrative examination. 

A special attention is paid to the improvement of the existing solution related to the procedures of filling the open vacancies by internal and external transfers with the aim of faster flow of staff and possible career advancement through internal vacancy competitions.

Also, a special attention was paid to the conditions of appointment of civil servants in the context of application of Framework Law on Higher Education in BiH (“Official Gazette of BiH” No. 59/07).

With an aim of strengthening of the authority of civil service, adoption of the Code of civil servants is regulated on the basis of previously taken up commitment of BiH by GRECO.

For the first time conditions and methods of protection of moral and physical integrity of civil servants in the office are prescribed, as well as harmonization of the provisions of this Law with lex specialis laws which refer to the areas of salaries and compensations on the basis of salary.

Another novelty is that this Law prescribes criminal provisions for the lack of implementation of the same, for natural and legal persons with an aim of consistent implementation of this Law.

The provisions of this Law substitute the provision related to the central register of staff, by introducing a new institute “Information System of Human Resources Management” which is being developed by the Agency with cooperation and finances of European Commission Delegation.
