Amendments to the Agreement on Mutual Execution of Court Decisions Agreed

21.05.2009. - Representatives of the Ministry of Justice of BiH and the Ministry of Justice of the Republic of Serbia agreed today in Belgrade the amendments to the Agreement on Mutual Execution of Court Decisions in Criminal Matters. Amendments to the Agreement will allow the execution of court decisions pronounced in one country, in cases where a convict is found in the other country. Previously, the convicted persons had to give their consent to serve their punishment, and that is abolished by this Agreement.

The same proposal of the Agreement, which was previously agreed with the Ministry of Justice of the Republic of Croatia, is offered to the Ministry of Justice of the Republic of Serbia. Namely, Ministry of Justice of BiH and the Ministry of Justice of the Republic of Croatia agreed last month the amendments to the Agreement on Mutual Execution of Court Decisions in Criminal Matters. Proposed amendments relate to the abolishion of "volunteerism" in the execution of criminal sanctions, because the existing Agreement defines that convicted persons must give their consent to serve their punishment in the other country.

Ministry of Justice of BiH has prepared the agreed amendments to the Agreement on Mutual Execution of Court Decisions in Criminal Matters with the Republic of Croatia, and after obtaining the opinions of the competent bodies and the approval of the Council of Ministers of BiH, the conditions for its signing will be created.
